Let's talk about what's happening in Upshur County...
http://www.kltv.com/global/story.asp?s=13762305
ReplyDeleteWell now, all the county employees showed up at the courthouse to support the elected criminals. Aint that sweet.
ReplyDeleteThey are criminals already? They have only been indicted, they won't become the criminals you so desperately want them to be until a trial finds them guilty. At that point they still might not be classified as criminals.
ReplyDeleteYou might also notice that the LNJ article cites that there is no Texas statute requiring public comment at public meetings.
You might also notice that the charges are "charges of official oppression and abuse of official capacity." The indictment has nothing to do with limiting freedom of speech.
It does not appear that Mr. Caughron's freedom of speech was infringed. He was able to use the media quite effectively to make his point. And it appears that he is using a legal system to do the same thing. Kudos to him. A previous LNJ article quotes Mr.Caughron as saying, "I'm having this investigated and possibly filing charges. . . against the court up there, I guess," Caughron said. "I'm going to definitely raise all kinds of Cain about this." He is using his freedom of speech quite well. Freedom of speech does not mean we can speak what we want, when we want. If you think so, stand up tomorrow in church and argue with your pastor during the service, yell "robbery" in a bank, go to Washington and argue with the speaker of the house during an open session.
The Upshur county suit is about how Mr. Caughron was treated, not freedom of speech.
And as far as calling them elected criminals, the people elected them, and they are not criminals. You may not like the people, but respect the office. Mr. Caughron deserves the same respect, not just as a citizen but as a veteran.
The LNJ has it wrong. They are in trouble for having Caughron removed from the courtroom. Thats why the Shriff is involved. If it were for removing public comment it would be the three commissioners and the county Judge. these men are Criminals they just haven't been caught and convicted yet but they are criminals. I capitalized criminal to show respect.
ReplyDeleteOutsider - Surprising that the press gets something wrong (lol). Look at all the posts on the LNJ article. Most have to do with abridgment of free speech when that's not really what happened here.
ReplyDeleteAnd they are not yet criminals, they need to be incarcerated first. Criminals get incarcerated.
Official Oppression may be difficult to prosecute: http://tinyurl.com/23g4hu7
Abuse of Official Capacity might be a stretch, too: http://law.onecle.com/texas/penal/39.02.00.html
But I'm not a lawyer and certainly not a DA.
The courts need to tussle it out and Byrd is just doing his job as a representative of the people. Although, as an outsider myself it sure seems like the animus and bitterness in Upshur County politics is almost beyond belief. How did it get that way?I come from Central New Jersey and I never read anything in the papers there like what goes on in our little county of 36,000 people. It's astounding!
